Personal Training Agreement

I, the client as recorded above, have enrolled in a program of strenuous physical activity containing respective conditioning routines and the use of exercise equipment, designed, offered, recommended, and/or supervised by Training Utilities. I hereby affirm that I do not suffer from any disability that would prevent or limit my participation in this program. In consideration of my participation in the program, I hereby release Training Utilities from any and all claims, demands or causes of action arising from my participation in the program or from any use of the conditioning and exercise equipment and facilities. I fully understand that I may suffer injury as a result of my participation in the program and I hereby release Training Utilities from any and all liability now or in the future, including but not limited to medical expenses, lost wages, pain and suffering, that may occur by reason of heart attacks, muscle strains, pulls or tears, broken bones, shin splints, heat prostration, knee/lower back/foot injuries, and any other illness, soreness, or injury, however caused, whether occurring during or after my participation in the program or use of the conditioning and exercise equipment and facilities, regardless of fault. *
In consideration of the mutual promises exchanged herein and other good and valuable consideration, the parties agree as follows: 1. Commitment: By purchasing sessions, the client is making a commitment to his/her health. The client should follow the program and instructions of the trainer to the best of his/her ability to maximize the results and better achieve their goals. Remember, the ultimate results are up to the client: The Trainer will show the client how to work his/her muscles correctly and encourage him/her to go to his/her safe limit, but the client is the only one who can make sure he/she works out consistently, eats properly and in accordance with their goals, gets plenty of sleep, and lives a general healthy lifestyle. 2. Location & Specifics: Trainer and client shall agree verbally upon the time, program type, content, and location of personal training sessions. If the client needs to be trained at a gym, the client will be responsible for their own entry costs. When training at the client’s residential area, we ask that the client ensures a clean space with adequate room to move all limbs. Clients that aren’t hindered by any distractions will likely reap greater benefits. 3. Length of personal training agreement: Each client is obligated to commit to one full calendar month of training and advanced payment, with a minimum of one session per week, unless a varible option has been provided by the trainer. The client must give one month notice prior to cancellation of this agreement. This agreement will be updated and revised annually from date of signing. 4. Length of individual personal training sessions: Each personal training session will last between 45-60 minutes total. We will always warm up, cool down and stretch, along with each session. 5. Payment: Client acknowledges and agrees that this personal training contract is not transferable or assignable. Payment for each month’s sessions must be completed in full, in advance, via Electronic Transfer or cash, due and payable upon invoice receipt according to each clients fitness option. Sessions purchased will only be valid for that specific month, and do not carry over. If the client, for any reason, does not fulfill all their sessions in the prescribed monthly time frame, no refund will be given. We regret no credit terms. 6. Punctuality: Failure to be prepared to train may result in a shortened workout or possible non refundable forfeit of the session. If the client anticipates running late, he/she should contact the trainer as soon as possible. If the trainer is later than 20 minutes, sessions will be rescheduled to a later possible date, or refunded. Please understand that with increasing volumes of traffic, road construction, speed limits and striking, that our trainers may be held up from time to time. 7. Stopping Exercises: The client may refuse or stop any exercise for any reason. It is the client's responsibility to notify the trainer of any discomfort or pain arising from, or during exercise, as well as any and all other known limitations the client has, or experiences, so that the trainer may accommodate the client and substitute or modify applicable exercises as required. 8. Cancellation of Individual Sessions: The client acknowledges that appointment times are reserved for the month ahead and any cancellations or reschedules must be made a minimum of Twenty-Four hours in advance, before the start of each scheduled training session. Sessions with the appropriate notice may be rescheduled to another date, at the discretion and availability of the personal trainer. Any cancellations with less than 24 hour notice will result in forfeiture of the session without refund. If the trainer must cancel a session, he will do so, by phone, with at least Twenty-Four (24) hour notice. Sessions canceled by the trainer will be rescheduled to a suitable alternative date. 9. Available personal training days/ hours: Personal training hours are available for booking from 5am to the last session booking at 5:30pm, Monday to Friday, weekly. Weekend sessions will be charged at standard rates plus 25%, unless offered by the trainer at standard rate. Training Utilities is closed for business on all South-African public holidays. Any other vacation dates will be communicated to the client with Thirty (30) days notice. The client will not be charged during this period. 10. Filming & Impropriety: Any client that films their training sessions in any manner, without the consent of Training Utilities, will face prosecution. Any form of sexual advances or harassment toward our trainers will be treated as the serious violation it is, where services will be refused, and where responsible clients will face prosecution and relevant legal implications. 11. What to expect from your trainer: Your trainer will design a personalized program that meets the client's needs and goals that is safe within all reason, effective and conductive. Your trainer will provide guidance regarding proper exercise techniques. Your trainer will maintain a record of client progress and provide necessary feedback. Your trainer will evaluate and modify the personalized program as necessary according to client progress, needs, and goals. All information regarding the client's program and progress is confidential and will remain on file with Training Utilities. 12. Our expectations from each client: The Client is expected to discuss all health history information and any medical concerns deemed applicable with the personal trainer. The Client is responsible for maintaining a healthy eating regime that is in-line with their fitness goals. Client will communicate any discomforts, pain or concerns experienced during or arising from a session. Client shall abide by rules and policies of Training Utilities and our supplying partners. We have the right to deny services to clients who fail to abide by such rules and policies. The client acknowledges that he/she is in good health and physically able to participate in a personalized physical fitness program. By signing below, client additionally acknowledges and agrees that he/she has no limiting health conditions that would preclude participation in an exercise program, and will immediately inform the trainer in such case. *
Client understands this is a legally binding contract, has read the contract, and fully understands its contents. This contract contains the entire agreement of the parties, and supersedes all prior negotiations, agreements and understandings with respect hereto. *
